DELIVERY
Higgins Agencies reserves the right to charge the freight cost to the Customer unless other arrangements have been pre-arranged. Higgins Agencies uses these preferred carriers unless specifically requested by the Customer. If the Customer requests a specific carrier, we cannot guarantee access to the despatch dock without prior notice. Freight costs for specific carriers cannot be prepaid; they must be "Freight Collect". For "Freight Collect", insurance responsibility for the products passes to the Customer once product has been passed to their carrier.

INSPECTION, DEFECTS AND NON-DELIVERY
The Customer must inspect the products as soon as is reasonably possible after delivery and Higgins Agencies shall not be liable for any defect in the products or shortages in delivery unless written notice is given to Higgins Agencies within 7 days of delivery. Higgins Agencies does not write software comprised in the products and it is the Customer's responsibility to check for the presence of computer viruses before the products are used. In the case of non-delivery, the Customer must notify Higgins Agencies immediately the invoice is received, otherwise no liability can be accepted. Any liability of Higgins Agencies for non-delivery or defective products shall be limited to, at Higgins Agencies discretion, replacing or repairing the products within a reasonable time or to refund any monies already paid in respect to the products. The Customer accepts liability for all freight costs incurred in the return of products including warranty repair or replacement of faulty goods without exception.

RETURNS
The Customer must receive an RMA number from Higgins Agencies prior to returning any products. A Return Authorisation form will be issued in approved cases and details including the original invoice number and date of purchase must be supplied by the Customer. Any product returned must be received by Higgins Agencies within 7 days of the original delivery and must be undamaged and unaltered and in original packaging. Certain products are excluded from the right of return and may not be returned under any circumstances. The Customer accepts liability for all freight costs incurred in the return of products including warranty repair or replacement of faulty goods without exception and a restocking fee of 15% applies.

1. Stock Returns for Credit
1.1 All sales are considered to be final, unless otherwise agreed in writing by an authorized representative of Higgins Agencies.
1.2 Products to be returned must have an RMA (Return to Manufacturer) number clearly visible on the outside of the package, and the
product must be unopened and in a resaleable condition acceptable by Higgins Agencies.
1.3 Products must be returned within 5 working days once an RMA number has been allocated.
1.4 Products that fail the above conditions will not be accepted and will be returned to the sender immediately at the sender's expense.
1.5 All returns are subject to a 15% re-stocking fee at the discretion of Higgins Agencies.

2. Warranty Returns
2.1
All defective returns will not be accepted without an RMA number from Higgins Agencies.
2.2 To qualify for an RMA number an invoice number MUST be provided.
2.3 All products returned MUST be clearly labelled with an RMA number on the outside of the carton and a detailed fault description
attached.
2.4 Higgins Agencies suppliers will firstly diagnose all returned products before replacement goods are despatched.
2.5 A charge of 20%, based on the invoiced amount, will apply to any returned products that are tested and found not faulty (based on
manufacturer's specifications). All costs associated with having the goods returned to the customer will be borne by the customer.
2.6 Higgins Agencies will honour manufacturer warranty periods beginning from Higgins Agencies invoice date or end users receipt date
depending on manufacturer's terms and conditions.
2.7 Products that are found deliberately damaged by customer or altered in any way will void warranty and products will be returned to
the customer at the customer's expense.

Higgins Agencies reserve the right to change any of the warranty terms and/or procedures for returns specified herein without notice.

Higgins Agencies accepts no liability whatsoever for time lost, or any damages or loss suffered by a customer as the result of a warranty or replacement return on any equipment.

Title of goods does NOT pass until payment is received in full.
